Learn about rent determination lawsuits, the 5-year rule, and the market-rate assessment process under the Turkish Code of Obligations. A comprehensive legal guide for property owners.
What Is a Rent Determination Lawsuit?
A rent determination lawsuit is a legal proceeding through which the court sets the rent amount when the landlord and tenant cannot agree on it, or when specific statutory conditions are met. Governed by Articles 344 and 345 of the Turkish Code of Obligations (TCO), this action is the primary legal instrument that allows a landlord to bring rent in line with current market rates — particularly after a rental agreement has completed five years or in long-standing tenancy relationships.
A rent determination lawsuit is distinct from a rent-increase dispute. In a rent-increase dispute, the parties contest whether an increase above the CPI rate is valid; in a rent determination lawsuit, the court sets the rent from scratch based on prevailing market conditions. Consequently, this action is a critical avenue for property owners whose rental income has fallen well below market value over the course of a long-term tenancy.
The 5-Year Rule: TCO Article 344
Under Article 344 of the Turkish Code of Obligations, a landlord may not seek a rent increase above the 12-month average CPI change rate before five years have elapsed from the start of the rental agreement; that rate constitutes the legal ceiling. In other words, rent increases are capped by CPI during the first five years.
Once the fifth year is completed, however, this cap is lifted. Pursuant to TCO Art. 344/3, in agreements exceeding five years the court shall determine the rent at an equitable level by considering comparable rents in the area, the characteristics of the property, and general economic conditions. This determination is independent of the CPI rate and can in practice lead to significant upward adjustments in favour of the landlord.
Important: The 5-year period starts from the date the tenant actually took possession of the property, not from the date the contract was signed. It is therefore crucial that the tenancy start date is explicitly stated and documented in the agreement.
Litigation Process and Required Documents
A rent determination lawsuit may be initiated by either the tenant or the landlord. The most common scenario for landlords is seeking an update to a rent that has fallen far below the market rate in a contract that has passed its fifth year. Before filing, TCO Art. 345 requires that written notice be served at least thirty days before the start of the new rental period; a claim filed without such notice may be deemed untimely.
Documents to Submit in the Lawsuit
- Rental agreement and any addenda (signed original or certified copy)
- Title deed or property registration document
- Written rent determination notice (notarised service or registered mail sent at least thirty days in advance)
- Comparable rental agreements or market research documents for the area
- Renovation or improvement documents that have increased the property's value (if applicable)
Competent Court and Jurisdiction
Rent determination lawsuits fall within the jurisdiction of the Civil Court of Peace (Sulh Hukuk Mahkemesi) under the Code of Civil Procedure No. 6100. The competent venue is ordinarily the court in the district where the leased property is located. Filing the claim, or at minimum serving written notice, at least thirty days before the new rental period begins is critical if the resulting judgment is to take effect from the start of that new period.
Expert Witnesses and Market-Rate Assessment
In rent determination lawsuits, the court always orders an expert-witness examination to establish the rent amount. The expert evaluates the property's location, intended use, floor area, age, technical condition, comparable rents in the area, and general economic conditions to calculate the market-rate rent. The examination may also include an on-site inspection of the property.
The expert report carries decisive weight in the proceedings; the court bases its rent-setting judgment on this report. However, the judge is not bound by the report and may order a supplementary examination if the report is found to be contradictory or insufficient. Once the judgment becomes final, the determined rent takes effect from the date specified in the decision.
How Is Market-Rate Rent Determined?
The market-rate rent is the actual rent paid for properties with similar characteristics in the open market. To establish this figure, the expert examines lease agreements for comparable residential units of similar size, floor, and condition in the same neighbourhood, price lists from real estate agents, current listings on property portals, and comparable rent data from municipal or land-registry authorities. Preparing a strong list of comparable properties is therefore a significant advantage for the landlord's case.
